These Terms of Use govern BlaBlaSell (the Service). By registering or using the Service you agree to these Terms and to our Privacy Policy. The Service may include: social networking; profiles, pages and groups; messaging; posts, comments, albums, hashtags, saved items, memories and similar features; short-form or ephemeral media (e.g. reels or status-style content); live streaming; voice and video calls; location-assisted features (e.g. friends nearby, nearby shops or business discovery, where enabled); marketplace listings that only facilitate contact between users (see Section 5); forums; blogs (including AI-assisted creation where enabled); events; jobs; funding or crowdfunding-style campaigns; games; movies-style catalogues or discovery; offers and promotions; advertising and SmartPromote-style tools; boosted or sponsored placements; wallet, in-Service purchases, send-money or transfer tools, withdrawals and creator monetisation (including subscriptions or “pro” features, where enabled); checkout or order flows for digital or other items the Operator makes available through the Service (if any); reviews; the Chainema module (streaming, catalogue, rentals, purchases or subscriptions where configured); developer tools (e.g. apps, OAuth, APIs); directories and explore-style discovery; and artificial intelligence features (e.g. moderation assistance, transcription, text generation—see Section 12). Not every feature is available in every territory or configuration.

Infrastructure. Core application hosting and object storage for the Service are provided using DigitalOcean infrastructure—specifically virtual servers (Droplets) and DigitalOcean Spaces (S3-compatible object storage)—in the region(s) configured by the Operator. Additional providers (e.g. payment gateways, email/SMS, real-time communications, CDNs, encoding, AI APIs) apply only when those integrations are enabled.
You must be at least 18 years of age to register and use the Service. If the minimum age for digital consent in your country is higher than 18, you must meet that higher age. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation and that you personally meet the age requirement.
You are responsible for credentials, accurate profile information, and all activity under your account. Notify us promptly of unauthorised use. We may suspend or terminate accounts that violate these Terms, create risk, or must be restricted for legal or security reasons. Phone or SMS verification may be used where enabled.
You retain rights to content you upload or stream. You grant the Operator a worldwide, non-exclusive licence to host, store, reproduce, adapt, publish, display, distribute and otherwise use your content solely to operate, promote and improve the Service, including moderation, technical processing (including encoding and streaming), backup, security and AI-assisted processing described in these Terms and the Privacy Policy. You represent that you have the rights needed for this licence and that your content does not infringe third-party rights or applicable law.
The Service may allow users to publish listings for goods, services or opportunities. The Operator does not sell those items through the marketplace feature and does not provide an in-platform checkout for those listings. The marketplace is intended free of charge as a way for potential buyers and sellers (or clients and providers) to discover each other and exchange messages or contact details. Any agreement, payment, delivery, warranty, tax, customs, consumer rights or dispute relating to a listing is solely between the users involved, except where mandatory law states otherwise. You must provide accurate listing information and must not use listings for fraud, illegal goods or services, or to circumvent safety or payment rules. The Operator may remove listings or restrict accounts. To the maximum extent permitted by law, the Operator is not responsible for user-to-user deals, meetings, communications or losses arising from listings.
Features such as pages, groups, follows, suggestions, directories and explore-style surfaces help you discover people and content. Rules for pages and groups may include additional roles (e.g. admins). You must not mislead others about identity, affiliation or popularity.
Live, voice, video and short-form media may be processed in real time through the Service and third-party infrastructure. You are responsible for lawful content and for obtaining rights and consents (e.g. for music, images of people or minors) as required by law. Do not use these features to harass, threaten, expose private data without authority, or broadcast illegal content.
Chainema may offer audiovisual content, metadata, trailers, community features, and paid options (e.g. rentals, purchases, passes or subscriptions). Availability, pricing, territories and device rules may vary. Unless expressly stated, licences are personal and non-transferable. The Operator may change or discontinue titles or features. Parental controls and age rules depend on your configuration and local law. Technical processing may include CDNs, encoding providers and, where enabled, speech-to-text or other AI-assisted tools as described in the Privacy Policy.
Payments may be processed by third parties (e.g. Stripe, PayPal, Payfast or other gateways enabled by the Operator). Wallet balances, credits, in-Service purchases, send-money or peer-style transfers, withdrawals, subscription or “pro” billing, and creator payouts are subject to the refund policy where enabled, to fraud prevention, and to processor rules. You authorise charges you initiate. Taxes and fees may apply. The Operator may withhold or reverse amounts where required by law or for abuse investigation.
The Service may display ads, sponsored placements, SmartPromote-style campaigns or boosted posts. Advertisers and promoters must comply with law and any ad policies the Operator publishes. You must not manipulate metrics, mislead users, or promote prohibited products or services.
These modules are part of the same Service. Content you post there is user content subject to Sections 4 and 16. Jobs, funding and events may involve legal obligations (e.g. employment, securities, fundraising rules) in your country—you are responsible for compliance. Games and movies modules may include third-party or licensed material subject to additional restrictions.
Where enabled, the Service may send content or metadata (e.g. text, media excerpts, logs) to AI providers (such as OpenAI, Moonshot/Kimi or others configured by the Operator) for features including moderation assistance, transcription, summarisation, search, or assisted authoring (e.g. blog drafts). Outputs may be inaccurate; you remain responsible for what you publish. See the Privacy Policy for categories of data and legal bases. Do not submit highly sensitive information you are not allowed to share with subprocessors.
Where you enable location features, the Service may collect or derive precise or approximate location to show nearby people, listings or businesses. You can withdraw permission through device or browser settings where applicable; some features may then be unavailable.
If you use OAuth, register apps, or call APIs, you must comply with developer documentation, rate limits, security requirements and data minimisation rules. You may not use credentials to access data you are not authorised to process. The Operator may revoke keys or suspend apps that create risk.
You must not: break the law; harass, threaten or harm others; distribute malware; attempt unauthorised access; scrape or overload systems; circumvent technical limits; impersonate others; post unlawful, defamatory, hateful, violent, sexually exploitative or infringing content; misuse payments, promotions, listings, AI outputs, or developer tools; or use the Service to arrange illegal transactions.
We may review, remove, restrict or disable content or accounts that violate these Terms or applicable law. Repeat copyright infringement may lead to termination of access.
United States — Digital Millennium Copyright Act (DMCA). If you believe material on the Service infringes your copyright, you may submit a notice of claimed infringement to the Operator’s designated agent. For BlaBlaSell, the designated agent is Roberto Calvo Productions Ltd, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, email: info@blablasell.com. You may also submit notices through the Contact page (use a subject line such as “DMCA notice”). Include at least: (1) identification of the copyrighted work; (2) identification of the material and its location (URL) on the Service; (3) your contact details; (4) a good-faith statement that the use is not authorised; (5) a statement, under penalty of perjury under U.S. law where applicable, that the information is accurate and you are authorised to act for the rights holder; (6) your physical or electronic signature. Knowingly misrepresenting infringement may expose you to liability. If you believe your content was wrongly removed, you may submit a counter-notification consistent with 17 U.S.C. § 512(g); we may restore content or terminate repeat infringers as the DMCA requires.
European Union, United Kingdom and other countries. You may use the same contact channels for copyright or related claims. Additional procedures may apply (e.g. under the Digital Services Act, national copyright law or platform rules). Nothing in this Section limits mandatory rights or remedies you may have under local law.
Links, embeds, logins or integrations (e.g. social login, CDNs, analytics, communication SDKs, payment processors, AI APIs) are governed by third-party terms. The Operator is not responsible for third-party services.
The Service is provided as available. To the extent permitted by law, the Operator disclaims warranties of merchantability, fitness for a particular purpose and non-infringement. User-generated content and user listings are not endorsed by the Operator. AI-generated suggestions are not professional advice.
To the maximum extent permitted by law, the Operator is not liable for indirect, incidental, special, consequential or punitive damages, or loss of profits, data or goodwill. Aggregate liability for claims relating to the Service is limited to the greater of amounts you paid to the Operator for the Service in the twelve months before the claim or fifty euros (€50), except where mandatory law provides otherwise. This does not limit liability that cannot legally be limited.
Mandatory consumer protections in your country of residence remain unaffected. For business users or where permitted, the Operator may designate governing law and venue in separate notices; replace this clause with advice from your counsel if needed.
We may update these Terms. Material changes will be communicated as required by law. Continued use after the effective date may constitute acceptance.
